General terms and conditions Chapter 1 1. general rules All deliveries and services of string-shop, Manuela Pötsch ( in the following "string - shop") are object to theses general terms and conditions. Alterations and/or supplementary regulations require the explicit written consent of "string-shop". This explicitly comprises the waiver of the requirement of written form. The contract language is German. 2. formation of a contract The formation of a contract occurs in the event you order goods and we confirm by an acceptance of the order. 3. the storage of the text of the contract The text of the contract will not be stored by us and may not be called up after the completion of the order transaction. However you may print the the data immediately after you have sent them to "string - shop". Chapter 2 1. Delivery times "String - shop" will react to customers orders within two working days. String - shop will - if possible - observe the delivery times as agreed upon in due time. In the event these delivery times will be exceeded by more than two weeks the client is entitled to set a time limit of two weeks after which he may refuse to accept the delivery. This time limit must represent two weeks. In the event an agreement for a new delivery date has not been reached the client may - after the expiration of the time limit - withdraw from the contract. In the event the client demands damages due to non-performance or the impossibility to perform under the contract entered into the damages are limited to the - in the event of slight negligence - the amount paid for the product. Especially the compensation of the loss of profit is excluded as well as any other indirect damages. Any other claims on behalf of the client - especially with regard to services - are excluded. Any further claims with regard to damages for pain and suffering remain unaffected if they result from loss of life, bodily harm or if they are the result of the detriment of the health. Chapter 3 Right of Cancellation You may cancel your contract in writing (e.g., letter, fax, e-mail) within 14 days without giving any reason or, if you received the merchandise prior to the specified date being reached, by returning the merchandise. The period begins the day after receipt of this written notification, but not before the merchandise has been delivered to the recipient (in case of recurring deliveries of similar merchandise not before receipt of the first partial delivery) and not prior to fulfilling our obligation to inform under article 246 § 2 in connection with § 1 section 1 and 2 of the Introductory Law to the Civil Code (EGBGB) and our obligations in accordance with § 312e section 1 clause 1 of the German Civil Code (BGB) in conjunction with article 246 § 3 EGBGB. In order not to exceed the cancellation period the merchandise must be returned or the cancellation sent within the cancellation period. Cancellation must be sent to: string-shop.de Mrs Manuela Pötsch Kabelwerk Straße 25 15517 Fürstenwalde Cancellation Consequences In the event of an effective cancellation, any payments received by either party must be returned and where applicable any benefits received (e.g. from interest) are to be surrendered. In the event you are unable to return the merchandise or benefits (e.g., from use) or only return them partially or in a deteriorated condition you may be liable to pay compensation for loss of value. You must pay compensation for the deterioration and for derived benefits in the event the use or deterioration is due to handling that exceeds evaluating the features and functions. "Assessing the features and functions" shall be defined as inspecting the merchandise in a manner customary in a retail shop. Merchandise which can be sent by parcel shipment are to be returned at our risk. You must bear the cost of return shipment if the merchandise which has been ordered has been shipped, if the price of the merchandise does not exceed 40 euro or, in the event of a higher price at the time of the cancellation, you have not made full payment or partial payment stipulated by contract. In all other cases return shipment is free of charge. Items that are not able to be shipped as a parcel will be picked up. Obligations to refund payments must be met within 30 days. This period shall commence for you upon dispatch of the cancellation or the merchandise, and for us upon receipt. End of Cancellation Policy Chapter 4 Risk of transfer of goods In the event transferred goods appear to show fabrication defects, which are also damages in transit, please inform us immediately or the person by whom the goods have been transferred to you. Please be aware that in the event of a belated information your claims concerning warranties may might be lost. Chapter 5 Bills of string shop are due to payment within 14 days and without any deduction. Starting with the 30. day string shop may calculate default interests. These default interests amount to 3 % above the actual discount rate of the Bundesbank. This does not apply if string shop has to pay upper interests or the client may proof lower costs which occur to string shop. Any admonition is not necessary. Checks are only accepted but not in lieu of payment. Any costs accrue to the client. Any setoff is only possible with undisputed or legally binding allowances. The right of retention may only be asserted if it is based on the same contract. Concerning the payment by credit cards these have to executed only after the posting of the goods. In the event the client asserted his right to revoke the declaration to enter into a contract the price will be reimburse, after the goods have been received by string - shop and no compensation has to be paid according to chapter 3. Chapter 6 Defaults Apparent claims e.g. concerning amplitude of deliveries, defaults, incomplete deliveries or quantity variance if these have been asserted have to be reported immediately at the latest one week after the reception of the goods delivered. The time limit for warranties for string shop follows from the law. The time limit starts with the reception of the goods at the client. The usual wear out does not establish a default and does not give any claim for warranties. In the event of well based claims of deficiency string shop will deliver the missing parts, take them back or - with reservations - change or offer the client an allowance. In the event of the replacement also the second delivery fails to be met the standards of the ordered goods the client may due to his choice reduce the price or hand the good back. Chapter 7 Reservation of proprietary rights The subject of the purchase remains the property of string shop until the complete settlement of the invoices of string shop due to the outstanding bills. This reservation of proprietary rights also applies for all outstanding debits of string shop in relation to the client and the goods purchased, e.g. any costs concerning repairs or other services rendered to the client, which string shop acquires subsequently. During the duration of the reservation period the client has the right to possess the goods in question and to use them according to the contractual obligations as long as he honours his obligations of the contract and the reservation of proprietary rights in time. The client is obliged to disclose any and all information to string-shop with regard to the reservation of proprietary rights. Chapter 8 Privacy policy We handle the personal data collected and use them beyond the order management for the customer relation management and for our marketing efforts. As a matter of course you may contradict any use for marketing purposes at any time. Please contact therefore - as well as for any information or if you wish to receive no more catalogues or any other marketing information to our data protection officer of string shop. Additionally string shop is authorized to use the data for the processing of orders, for customer relation management, for marketing initiatives as well as to use them for the solvency check. The data will be stored by the enterprise which accomplishes the solvency check. By the way you may contradict the above mentioned use for marketing initiatives at any time. Chapter 9 Copyright of string shop All content and especially all pictures produced by string shop and especially all pictures of this website are protected by copyright. This protection either applies equally to the photo-grapher, the owner of the licences, the producer or the merchant or myself or any other person whose products are displayed on this website. Additionally also the content of this website is protected or the website itself. The protected photos, the content of the website or the website or parts of it may not be reproduced, displayed publically, made available in the internet and used in any other way without prior written consent. Chapter 10 Further regulations concerning only enterprises Only in the event the client is an enterprise the following applies : The nullity of single clauses of this general terms and conditions does not affect the validity of any other clauses of these general terms and conditions. In place of such a clause a new clause will be construed which in its economic effect will replace the invalid clause. The place of execution and the place of jurisdiction for all contracts which are entered upon under these general terms and conditions is Fürstenwalde. The relevant law is the German law. The regulations of the UN Convention on the Sale of goods are excluded as far as this is legally allowed.
